History of the Klaipėda Regional Court

At the end of the Second World War, Lithuania including Klaipėda region were occupied by the Soviet Union for five decades. The judicial system was reorganized in accordance with the two-level system model.

 

Judicial system in Soviet Lithuania consisted of the Public Courts divided into several districts and the Supreme Court of the Lithuanian SSR. The 1th-5th District Public Courts of Klaipėda City were established in Klaipėda.

 

A new judicial system in Lithuania was created after the reform in 1958-1961. Since 1st of April, 1959 all five district public courts were brought together within a single court - the Klaipėda City Public Court.

 

Such court system proceeded until the 1st of January, 1995, when on 31 of May, 1994, Law of the Republic of Lithuania on Courts established a new court system.

 

Judiciary reform has been started since the restoration of Independence of the Republic of Lithuania in 1990. The first attempt to reform the system was made on 6 February 1992, when The Law of the Republic of Lithuania on Courts was adopted. The Article 1 of this Law provided four-level court system of Lithuania, consisting of district courts, regional courts, the Court of Appeals and the Supreme Court.

 

However, according to this Law, only the district courts and the Supreme Court were established. The Klaipėda City District Court was established in Klaipėda as well. For the establishment of regional courts and the Court of Appeal it was necessary to adopt relevant procedural laws, also find the funds for the implementation of this reform.

 

For these reasons, regional courts of Vilnius, Kaunas, Klaipėda, Šiauliai and Panevėžys started operating since the 1 of January, 1995, when the Law on the Lithuanian Supreme Court, Court of Appeal of Lithuania, regional courts and the establishment of regional and district courts operating areas for identifying and reforming the Lithuanian Prosecutor's Office, adopted on the 15th of June, 1994, entered into force.

 

As provided by the Law, there are 9 district courts in the territory of Klaipėda Regional Court: Klaipėda City District Court, Palanga City District Court, Klaipėda Region District Court, Kretinga Region District Court, Plungė Region District Court, Skuodas Region District Court, Skuodas Region District Court, Šilalė Region District Court, Šilutė Region District Court, Tauragė Region DistrictCourt.

The Klaipėda regional court is the first instance for criminal and civil cases assigned to its jurisdiction by law, and appeal instance for judgements, decisions, rulings and orders of district courts. The Chairman of a regional court organises and controls the administrative activities of district courts and their judges within the territory of his activities in accordance with the procedure prescribed by law.

 

The Law of the Republic of Lithuania on Courts provides that the Court of Appeal of Lithuania shall be the appellate instance for cases involving decisions, judgements, rulings, resolutions and orders taken by regional courts.

 

According to the Decree of the President of Lithuania (19 December 1994) Rasa Valentinienė was appointed as the first chairperson of Klaipėda Regional Court; on the 28th of April, 1998, Mr. Algirdas Gailiūnas was appointed to this possition. Since the 21st of June, 2010, Klaipėda regional court is headed by Arvydas Daugėla. Since 1st of July, 2019, Klaipėda regional court is headed by Marius Dobrovolskis.
